No Immigration Session This Thursday

This week's immigration advice session by CHIRLA for Thursday is CANCELLED due to scheduling conflict.

Are You a "Dreamer"?

Following the news about the Dream Act and immigration?

If you feel you may qualify under President Obama's new immigration status policy, now is the time to gather documents like school records.

The government has not released the requirements yet; but, you can be prepared.

Right now there is no clear guidance on how to apply for deferred action.  The US Citizenship and Immigration Services (USCIS) has promised to have an application process ready to go by August 15.

The thing to do right now is to gather documents that prove your identity, that you have lived here since June 15 of 2007 and that you have been in school.  When the application process is open you need to make sure that it is safe for you and your family to apply for deferred action.

CHIRLA is preparing a mailing to students but it will also have information posted on the  website at www.chirla.org  Check it out. It is constantly being updated  with the latest information.

"Deferred Action" Details


APPLY NOW FOR PRESIDENT OBAMA'S NEW IMMIGRATION

POLICY: "DEFERRED ACTION"

President Obama's new immigration "law" ... is actually only a “policy.” It coudl change depending on the results of  the November 2012 election. Go to the website at www.immigrationhelpla.com & click on “Helpful Info.”

WHEN TO ACT?

While no formal application is available yet, we know the basic outline of what will be necessary. Begin preparing for Deferred Action now

before there are possible changes. The law office will ensure you are among the first to apply when DHS

formalizes the application process in August.

WHICH BENEFITS WILL I RECEIVE?

You will receive employment authorization, a Social Security number, the right to apply for a drivers license and car insurance and the right

to live in the U.S. without fear of "deportation" for two years and possibly longer. Currently, this is not a path to a green card or citizenship

but this may change in the future, but...

ONE POTENTIAL PATH TO CITIZENSHIP

Because children 18 are not penalized for unlawful presence, if children under 18 years of age receive this deferred action benefit, they will

not have any "unlawful presence" problems. Therefore, if they go to college they can apply for an H-1B visa after graduation for "specialty

occupation" employment. From there, they may be eleigible for a green card and later citizenship. It is not an easy path; but, the lesson here is

that your B.A. will be worth something very important!!!

HOW MUCH WILL IT COST?

Depending on the way the rules are written, most immigration attorneys will charge from $1000-$2000 for the deferred ation application. To

celebrate this new law and to show commitment to the DREAMers a law office will process the first 100 applications under a special "family

and friends" discount for as low as $750-- and they will process the case from the comfort of your own home. While it is not known how much

the government will charge to file, you can be sure that you will only pay this low amount to the lawyers.


GENERAL REQUIREMENTS


● You were born AFTER June 15, 1981.

● You came to the U.S. BEFORE your 16th birthday.

● You have been here for at least 5 years.

● You have not been convicted of any serious misdemeanors or felonies.

● You are currently in K-12 school or have your GED or high school degree or honorably served in the U.S. Coast Guard or U.S.

Armed Forces.

Mientras que no hay una solicitud formal disponible todavia, sabemos el perfil basico de lo que va hacer necesario.

Comienze a preparar ya la Accion Diferida antes que los Republicanos en el Congreso o el nuevo Presidente Republicano la haga volcar.

quizas mas tiempo.

UN POTENCIAL CAMINO A CIUDADANIA
Porque ninos/jovenes de 18 no son penalizados por presencia ilegal, si ninos/jovenes

menor de 18 anos reciben este beneficio de Accion Diferida, ellos no tendran problemas de “presencia ilegal”. Por lo tanto, si van a la

universidad ellos pueden aplicar para la visa H-1B despues de la graduacion como empleo bajo “ ocupacion especializada”. De ahi, ellos

pueden ser elegibles para residencia permanente y despues ciudadania. No es un camino facil, pero la leccion de esto es que el B.A

(Licenciatura en Letras de la Universidad) sera de mucho valor!!!

CUANTO ES EL COSTO?
Dependiendo de como escriban las reglas, la mayoria de abogados van a cobrar entre $1000-2000 para la

solicitud de accion diferida. Para celebrar la nueva ley y demostrar compromiso a los DREAMers, nuestra oficina procesara las primeras 100

solicitudes bajo un descuento especial “familia y amigos” de una cantidad baja de $750 y el proceso se va hacer en la comidad de su propio

hogar. Como no sabemos cuanto va a cobrar el gobierno para someter, usted tengalo por seguro que usted va a pagar una cantidad muy

baja a nosotros.

Requisitos generales:

● Usted nacion DESPUES del 15 de junio de 1981

● Usted entro a los Estados Unidos ANTES de sus 16 anos

● Usted a vivido aqui por lo menos 5 anos

● Usted no ha sido condenado por una falta grave o un delito

● Usted esta actualmente en la escuela en K-12 grado, o ya tiene su diploma de secundaria (high school) o el GED, o sirvio

honorablemente en la Guardia Costera o Fuerzas Armadas de los Estados Unidos
